No criminals here, just us real estate agents ? The Eastsider LA

A police helicopter hovered over the 2300 block of Loma Vista Place in Silver Lake on Tuesday afternoon after a? resident reportedly came across three men in her home. But it turned out these guys were on the prowl for real estate,? not laptops, according to the LAPD Northeast Division Twitter feed:

Police activity, 2300 blk Loma Vista Pl (Silverlake). Woman went home, discovered 3 men inside. No crime, realtors only.

It?s not clear who the agents were working for or what home they were touring. There are no homes for sale in the 2300 block of? Loma Vista Place, where properties are reachable only via a public? stairway.? Meanwhile, real estate agents with nearby listings said none of their clients had reported coming across an unannounced trio of wandering real estate agents.? The watch commander at the LAPD?s Northeast Division? said this morning that all he knew about the incident was that no crime had been committed.

Perhaps some agents got the wrong address and day for the broker caravan?

(AP) ? Penn State's season opener on Saturday will be the first since 1949 not featuring someone with the last name Paterno on the coaching staff. They're out of the picture, like the campus statue of the family patriarch; erased like his coaching records.

But the family will be in Beaver Stadium in spirit, if not watching from a skybox ? a sign that through the turmoil of the past few months, life goes on for the clan that was synonymous with Penn State for decades and remains firmly rooted in a supportive community.

Scandal tarnished the legacy of the late Joe Paterno, the Hall of Famer who coached the Nittany Lions until his firing in November days after former assistant Jerry Sandusky was arrested on child sex abuse charges. Son and former longtime assistant coach Jay Paterno no longer tutors the quarterbacks.

Jay Paterno, one of Joe and Sue Paterno's five children, has been traveling and writing columns at a time when he's usually used to getting ready for the season opener.

"It's such a change in your lifestyle. Credit to Jay. Jay has kept himself busy. He's smart enough, savvy enough," said Tim Sweeney, a businessman and former player who is head of the Football Letterman's Club. Sweeney, who said he can relate as a former high school coach himself, briefly saw Jay Paterno at a charity golf outing in early August.

"Still, their hearts will be at Beaver Stadium on Saturday," said Sweeney, referring to Jay Paterno and the other veteran assistants who left after the arrival of Bill O'Brien, Paterno's replacement as head coach.

The family, as part of Paterno's employment agreement, received use of a Beaver Stadium suite for 25 years. Family members intend to attend the season opener against Ohio University on Saturday, but only to show their support for the new regime, family spokesman Dan McGinn said.

"The family doesn't want to do anything to distract from the game this weekend," he said.

Affixed to the front screen door of the Paternos' modest ranch home is a copy of a blue and white sign also on display in the windows of most downtown businesses, some homes and even cars. The message on the sign reads: "Proud to Support Penn State Football."

Members of the Paterno family either did not return calls or would not comment for this article. But the community of State College, often known as Happy Valley, appears to remain protective of the closest thing it has to a royal family.

Neighbors said that while Sue Paterno might venture out a little less than before the scandal hit, grandchildren, other relatives and friends still stop by the house regularly. Well-wishers, strangers among them, drop off Penn State paraphernalia or other messages of support in the front yard or doorstep.

Most in the broader community who talked to The Associated Press said what happened was tragic and they're sympathetic to the sex-abuse victims, but they perceived a rush to judgment about Joe Paterno's role in the scandal.

Sue Paterno continues to volunteer with Special Olympics, a charity she has long championed. A new Catholic student center across the street from campus bearing her name appears near completion.

"We are so grateful to her and the entire Paterno family for their dedication, prayers, and support," the Roman Catholic Diocese of Altoona-Johnstown said in a statement. "Because of Mrs. Paterno and so many others, Catholic students at Penn State will soon have a place to call their very own."

Sue Paterno stayed mostly out of sight at a summer pep rally for the team, save for a brief appearance at a side door of Penn State's football building. Unseen by most of the dozens of fans at the early morning rally, she was there and gone ? quickly.

Lawyer and former Penn State defensive back Adam Taliaferro, now a university trustee, grew close to the Paternos after suffering a serious spinal cord injury in a game against Ohio State in 2000. He said he spoke to Sue inside the football building while fans rallied outside and told the AP she was "one of the strongest women I know."

"All of us together will help her get through it," Taliaferro said. "She will always remain a huge part of the university."

Paterno started with Penn State as an assistant coach in 1950, becoming head coach in 1966.

Former FBI Director Louis Freeh's university-commissioned report in July said Paterno and three other school officials concealed allegations against Sandusky. Ten days later, the school took down the bronzed statue of Paterno outside Beaver Stadium.

Then, the NCAA announced it had accepted the findings and levied unprecedented penalties on the program including a four-year bowl ban, significant scholarship cuts and a $60 million fine. The NCAA vacated every Penn State win from 1998-2011, and Paterno was stripped of 111 career victories ? meaning he no longer holds the record for most coaching wins in major college football.

Paterno, who was diagnosed with lung cancer days after his firing, was not interviewed by Freeh's team, and the family said the NCAA had not contacted the family or the family's attorney. He died in January.

The family has said university leadership and the NCAA accepted Freeh's conclusions in a rush to judgment, without due process and a questioning of the findings. They vowed after Freeh released his findings that they would conduct their own investigation, which is ongoing, McGinn said.

"They're not looking for sympathy," McGinn said when asked how the Paternos have reacted to criticism. "The family is very stoic about this. The intent is just that the complete truth comes out."

Former Decorated Marines Surpass $20 Million in Funding for Lima One Capital, LLC

Lima One Capital LLC, an Atlanta hard money lender recently surpassed $20 Million in funding. Lima One Capital?s mission seeks to revolutionize and stabilize the residential real estate industry by providing first-mortgage loans to real estate investors seeking to purchase and renovate distressed homes. The company offers clients highly competitive rates, transparent terms, unmatched operational efficiency, great customer service, and fast closings. Lima One Capital currently lends in Georgia and South Carolina, with Atlanta representing its largest market. The company plans to expand to North Carolina next month, and eventually, throughout the country.

Atlanta, GA (PRWEB) August 29, 2012

Six years ago, John Warren and John Thompson were commanding Marines in a hard fought counter-insurgency in the ?world?s most dangerous city? of Ramadi, Iraq.

Today, however, the leaders of Lima One Capital, LLC, are shepherding $20 Million in funding for their fast-growing, residential hard money lending company with a new mission: revolutionize and stabilize the residential real estate industry by providing first-mortgage loans to real estate investors seeking to purchase and renovate distressed homes.

Instead of M-16 rifles, their new weapons of choice derive from the company?s highly competitive rates, transparent terms, unmatched operational efficiency, great customer service, and fast closings.

?We love the real estate investing industry because we recognize the social and economic impact that our clients have on communities and the economy as a whole,? says CEO John Warren.

Lima One Capital currently lends in South Carolina and Georgia, with Atlanta representing its largest market. The company will add North Carolina to the lending lineup next month as part of its domestic expansion.

?Our professionalism, integrity and customer service, gives clients a real alternative to traditional hard money lenders who are poorly capitalized and ridden with high rates and junk fees,? explains Warren. ?We quickly became the premier Atlanta hard money lender for real estate investors purchasing properties in Atlanta and we plan to bring that same model to each new market we serve,? Warren adds.

Clients of Lima One Capital span the globe. ?We serve ?hands-on? real estate investors in Atlanta, passive investors throughout the U.S. and seven foreign countries,? states COO, John Thompson. ?We do more than average Atlanta hard money lenders who just provide clients with capital. We ensure deals will be successful with our underwriting and construction draw processes. Additionally, we can introduce clients to our extensive network of real estate professionals who will assist them with property acquisition, construction and sales. We are a one stop shop for investors.?

It?s a convenience Lima One Capital client Dr. Larry Pohl appreciates. Pohl, who practices internal medicine in San Diego, invests in residential real estate in his free time. ?Not only was Lima One Capital professional and friendly, but we were able to secure a fair financial package and close within five days? Pohl said. ?I would recommend this company very highly without reservations for anyone needing loans for rehabilitating projects,? he added.

Lima One Capital clients? represent the ever-growing segment of investors within residential real estate. Recent market studies show that 27% of all homes purchased in the U.S. are by investors planning either to rent the property or ?flip? the property to an owner-occupier or another investor. Because most of these investment properties require significant construction, banks hesitate to lend on such collateral, leaving a void for investors seeking to leverage their capital.

Karina Miles is proof why this leverage is so vital to investors. Miles made a down payment of $23,780 on an investment property and elected for Lima One Capital to provide the remaining $98,924 to complete the project. In just over three months, Miles? contractor finished the project and the property sold for $191,000. Miles walked away from the deal with a profit of $53,512 and a return on her investment of 191%. Meanwhile, she was able to purchase two additional investment properties using Lima One Capital loans. Without Lima One Capital, Miles would not have chosen to fund three projects simultaneously. ?It has been a pleasure working with them and every step of the way they have been able to answer questions and lead me in the right direction with any assistance I might need,? Miles said.

Lima One?s attention to detail, dedication and service was forged in combat. Warren founded the hard money lending company in January 2010 in Atlanta, paying tribute in name to the Marines he commanded in 1st Platoon, Lima Company, 3rd Battalion, Eighth Marines. Thompson also served in Lima Company as the unit?s company gunnery sergeant. ?There was no other Marine I respected more than John Thompson. We developed a great working relationship while deployed in Ramadi, and I knew his operational skills complimented my strategic planning,? said Warren.

Eyeless Australian fish have closest relatives in Madagascar

ScienceDaily (Aug. 29, 2012) ? A team of researchers from Louisiana State University and the American Museum of Natural History has discovered that two groups of blind cave fishes on opposite sides of the Indian Ocean are each other's closest relatives. Through comprehensive DNA analysis, the researchers determined that these eyeless fishes, one group from Madagascar and the other from similar subterranean habitats in Australia, descended from a common ancestor before being separated by continental drift nearly 100 million years ago. Their study, which appears in the journal PLoS ONE this week, also identifies new species that add to existing biological evidence for the existence of Gondwana, a prehistoric supercontinent that was part of Pangaea and contained all of today's southern continents.

"This is the first time that a taxonomically robust study has shown that blind cave vertebrates on either side of an ocean are each other's closest relatives," said Prosanta Chakrabarty, an assistant professor and curator of fishes at Louisiana State University's Museum of Natural Science. "This is a great example of biology informing geology. Often, that's how things work. These animals have no eyes and live in isolated freshwater caves, so it is highly unlikely they could have crossed oceans to inhabit new environments."

The cave fishes, of the genus Typhleotris in Madagascar and Milyeringa in Australia, are small -- less than 100 millimeters long -- and usually lack pigment, a substance that gives an organism its color and also provides protection from the sun's ultraviolet radiation. These characteristics, coupled with a lack of eyes and enhanced sensory capabilities, allow cave fishes to survive in complete darkness. For this reason, the fishes have very restricted distributions within isolated limestone caves. It's also why the newfound genetic relationship between the trans-oceanic groups is an exciting geological find.

"The sister-group relationship between cavefishes from Madagascar and Australia is a remarkable example of Gondwanan vicariance -- a geographical split dating back to the Late Cretaceous some 100 million years ago," said John Sparks, a curator in the Division of Vertebrate Zoology at the American Museum of Natural History. "The interesting thing about Madagascar's extant freshwater fish groups, with the exception of a single species, is that all exhibit relationship patterns that are in time with the Mesozoic breakup of Gondwana -- some are related to groups in India/Sri Lanka, and others to groups in Australia. Only a single freshwater species has its closest relative in nearby Africa."

One of the new species discovered by the researchers, which will be named in a future publication, is a novelty among cave fishes because it is fully and darkly pigmented. The analysis the researchers conducted for this fish's tree of life shows that it evolved from a pigment-free ancestor, indicating that some subterranean forms can "reverse" themselves for this character.

"It is generally thought that cave organisms are unable to evolve to live in other environments," Sparks said. "Our results, and the fact that we have recently discovered new cave fish species in both Madagascar and Australia belonging to these genera, are intriguing from another perspective: they show that caves are not so-called 'evolutionary dead ends.'"

Funding for the research expedition was provided by the Constantine S. Niarchos Expedition Fund, established by the Stavros Niarchos Foundation to support the research of museum curators around the globe. This particular expedition turned into more of an adventure than the group was planning -- in fact, one of the new species has been given a moniker that means "big sickness" in Malagasy because of the dangers the team incurred while searching for specimens in this dry, inhospitable region of Madagascar.

"Only two specimens of the new pigmented form were recovered from the first cave we searched in Madagascar, despite the fact that we spent hours in this sinkhole," said Chakrabarty. "Even the locals hadn't been inside of it before."

Because remote locales with caving opportunities exist all over the world, the researchers are eager to pursue other opportunities for discovery.

"Conducting this research really developed my love for caving," said Chakrabarty. "You don't always find something exciting. But, when you consider how isolated many of these caves are, especially in places like Madagascar, and how unaffected they have been by the passage of time, you know that the fish in there are going to tell a really good story."

Sony launches STR-DA5800ES home cinema AV receiver: true 4K output, 9.2 surround sound

DNP STRDA5800ES home cinema

Sony's just launched a high-end home cinema receiver that's finally good enough to pair up with its IFA-fresh Bravia KD-84X9005 TV or existing VPL-VW1000ES 4K projector. On top of native 4K for supported displays, the receiver will upscale standard HD movies, promising greater color, contrast and detail. For audiophiles, the system has 9.2 channels of surround sound for so-called Front High and Surround Back speakers, on top of the standard 5.1 speaker setup. A feature called "Movie Height" enables the sound to be virtually adjusted up or down to better match the screen position, and acoustics can be selected to match famous concert halls like those in Vienna or Berlin. Finally, you can take advantage of all that Hi-Fi and display tech by streaming from your laptop, smartphone or tablet through a LAN hub on the receiver. There's no availability or pricing yet, but if you're not too concerned about that money stuff, check the PR for the rest of the story.

Capturing movements of actors and athletes in real time with conventional video cameras

ScienceDaily (Aug. 28, 2012) ? Within milliseconds, and just with the help of mathematics, computing power and conventional video cameras, computer scientists at the Max-Planck-Institute for Informatics in Saarbr?cken can automatically capture the movements of several people. The new approach helps not only animation specialists in Hollywood movies but also medical scientists and athletes.

In the computer graphics (CG) animated comedy "Ted," which is running now in the cinemas, Ted is a teddy bear who came to life as the result of a childhood wish of John Bennett (Mark Wahlberg) and has refused to leave his side ever since. CG Animated characters like "Ted" have become a standard of Hollywood's movie productions since the blockbuster "Avatar" with its blue-skinned computer-animated characters won three Oscars and brought in three billion US dollars, digital animated characters have become a standard of Hollywood's movie productions.

While movies like "Pirates of the Caribbean" or "Ted" still combined real actors with digital counterparts, the well-known director Steven Spielberg focused entirely on virtual actors in "The Adventures of Tintin." He used the so-called motion capture approach, which also animated Ted. Motion capture means that an actor wears a suit with special markers attached. These reflect infrared light sent and received by a camera system installed in a studio. In this way, the system captures the movements of the actor. Specialists use this as input to transfer exactly the same movements to the virtual character.

"The real actors dislike wearing these suits, as they constrain their movements," explains Christian Theobalt, professor of computer science at Saarland University and head of the research group "Graphics, Vision & Video" at the Max-Planck-Institute for Informatics (MPI). Theobalt points out that this has not changed since animating "Gollum" in the trilogy "Lord of the Rings." Hence, together with his MPI-colleagues Nils Hasler, Carsten Stoll and J?rgen Gall of the Swiss Federal Institute of Technology Zurich, Theobalt developed a new approach that both works without markers and captures motions in realtime. "The part which is scientifically new is the way in which we represent and compute the filmed scene. It enables new speed in capturing and visualizing the movements with normal video cameras," Theobalt explains.

Implemented, it looks like this: The video cameras record a researcher turning cartwheels. The computer gets the camera footage as input and computes the skeleton motion of the actor so quickly that you cannot perceive any delay between the movement and its overlay, a red skeleton. According to Theobalt, the new computing approach also works if the movements of several persons have to be captured, or if they are obscured by objects in the studio and against a noisy background.

"Therefore we are convinced that our approach even enables motion capture outdoors, for example in the Olympic stadium," Theobalt points out. Athletes could use it to run faster, to jump higher or to throw the spear farther. Spectators in the stadium or in front of the TV could use the technology to tell the difference between first and second place. Besides entertainment, medical science could also benefit from the new approach, for example by helping doctors to check healing after operations on joints.

In the next months his MPI colleagues Nils Hasler and Carsten Stoll will found a company to transform the software prototype into a real product. "They've already had some meetings with representatives sent by companies in Hollywood," Theobalt says.

Technical background

The new approach requires technology which is quite cheap. You need no special cameras, but their recording has to be synchronized. According to the MPI researcher, five cameras are enough that the approach works. But they used twelve cameras for the published results. The way they present the scene to the computer and let it compute makes the difference. Hence, they built a three-dimensional model of the actor whose motions should be captured. The result is a motion skeleton with 58 joints. They model the proportions of the body as so-called sums of three dimensional Gaussians, whose visualisation looks like a ball. The radius of the ball varies according to the dimensions of the real person. The resulting three-dimensional model resembles the mascot of a famous tire manufacturer.

The images of the video cameras are presented as two-dimensional Gaussians that cover image blobs that are consistent in color. To capture the person's movement, the software continuously computes the best way that the 2D and 3D Gaussians can overlay each other while fitting accurately. The Saarbr?cken computer scientists are able to compute these model-to-image similarities in a very efficient way. Therefore, they can capture the filmed motion and visualize it in real-time. All they need is just a few cameras, some computing power and mathematics.

"I want Football to Trump Cricket in India within 8 years!" Amit Saran ...

?My motivation was an article in an English daily which I came across in Delhi in 1991 about an Asian Games gold medallist wrestler selling ?channa? (grams) in Chandni Chowk lanes. Something happened and then I decided to do my bit for the future of kids who love sports and wish to make a living / career of it. Initially it all started as a hobby by organising sports events for children since 1992 in Noida (near Delhi) but it was only in 1998 after moving to Bangalore that I quit my job and took sports promotion as a profession.?

On the business front, Sports is now more than just a play, it?s a rising industry. Sports management is an industry that is growing rapidly in India. Sports being a ?sunrise industry?, it was difficult to arrange for manpower. Still, Amit went ahead with his plans and was able to set up a dedicated team. New on video: 'Battleship,' 'The Pirates! Band of Misfits,' 'Think Like a ...

    ?The Pirates! Band of Misfits?

What is it? The charmingly goofy animated feature showcases characters known only as the Pirate Captain, the Pirate With Gout, the Albino Pirate, etc. The day-to-day business of pirating ? they?re not so good at. Adapted by Gideon Defoe from his series of children?s books, ?The Pirates!? is built around the premise of a reality-TV-style contest between the Pirate Captain and three other blackguards: Black Bellamy, Cutlass Liz and Peg Leg Hastings. In his search for ships filled with booty, the Pirate Captain accidentally sacks the HMS Beagle, the research ship of Charles Darwin (voiced by David Tennant), leading to a more landlocked, and delightfully ludicrous, adventure. Like many Aardman Animations films, this one is awash with silliness. It has enough humor to keep Mom and Dad from falling asleep. As with Aardman?s ?Wallace and Gromit? films, there?s a sardonic animal sidekick. Perhaps, by the second ?Pirates!? film, there will be a character as beloved as Gromit. In the meantime, ?The Pirates!? has made a buoyant maiden voyage. Rated PG for mild cartoon action and some rude humor Time: 1:28 We gave the film: *?*? Extras: Filmmakers? commentary, ?So You Want to Be a Pirate!? mini-movie and ?Mr. Bobo?s Flash Card Challenge.? Also, on Blu-ray: ?Pirate Disguise Dress-Up? game, making-of featurette, ?Creating the Bath Chase Sequence? featurette, two Peter Lord short films?Battleship? What is it? Hasbro?s venerable game of naval strategy, in which players use a combination of guesswork and logic to deduce the location of their opponents? ships, isn?t exactly known for its thrill-a-minute narrative complexity. Fear not. ?Battleship? is an invigorating blast of cinematic adrenaline. Deftly directed by Peter Berg, from a script by brothers Eric and Jon Hoeber that adds muscle, sinew and heart to the skeletal source material, the resulting film is an enormously entertaining amusement-park ride. Yes, it?s a bit preposterous, not to mention loud. But it?s also brisk and viscerally thrilling, with a genuine surprise or two ? including a plot twist that manages to brilliantly incorporate the game?s essential DNA of blindly shooting at invisible targets. It?s the action that propels this fleet film forward. Like its naval namesake, ?Battleship? may be bulky, long and overblown, but when it gets in the water it?s as nimble as a speedboat. Sure, it may be beset by a few cliches, but it manages to outmaneuver them all in the end. Rated PG-13 for action violence, mayhem and some obscenity Time: 2:12 We gave the film: *? Extras: Featurettes ?Preparing for Battle,? ?All Hands on Deck: The Cast? and ?Engage in Battle.? Also, on Blu-ray: alternate ending pre-visualization and five featurettes, including a short on visual effects, a behind-the-scenes with director Peter Berg, ?USS Missouri VIP Tour? and ?Alien Tech 3D Model Turntable Explosions? ?Think Like a Man? What is it? An all-star revue of some of the most physically stunning actors in Hollywood, ?Think Like a Man? is a pleasure if only on a purely sensory level. The nine main characters might be archetypes-bordering-on-stereotypes, but all manage to resemble authentic human beings, thanks to the terrific actors who play them, including Taraji P. Henson, Meagan Good, Regina Hall and Gabrielle Union. Each of these gorgeous, high-achieving, self-aware women faces a specific dating problem for which Steve Harvey?s relationship book has just the right advice. That advice ? with its 90-day rules before having sex and warnings against being a ?chirp-chirp? girl ? doesn?t break any ground. Forget hackneyed cliches about Players and Dreamers and the scheming women who seek to domesticate them. Focus on the pleasures of watching a group of gifted actors spar and seduce each other with genuine warmth, and ?Think Like a Man? just might go straight to your head. Rated PG-13 for sexual content, some crude humor and brief drug use Time: 2:02 We gave the film: *?*?*? Extras: deleted scenes, blooper reel. Also, on Blu-ray: four behind-the-scenes featurettes? The Lucky One? What is it? Can a drama be too restrained? ?The Lucky One,? adapted from a Nicholas Sparks novel, features Zac Efron and Taylor Schilling in a sudsy romantic melodrama that lavishes good taste and sunsets on a story that ? devoid of genuine tension, conflict or combustible chemistry between its two stars ? just prettily sits there. Efron plays Logan Thibault, who as a Marine in Iraq happens upon a photograph of a beautiful blonde and proceeds to see the picture as a talisman that saves his life. When he returns to the United States, he tracks down the girl, who turns out to be a single mother named Beth (Schilling), and begins working in the dog kennel she runs with her grandmother, played with vinegary acumen by Blythe Danner. Most of ?The Lucky One? consists of proving how sensitive Logan is (he reads Melville and plays the piano with a suitably faraway look) and how put-upon Beth is as she clatters around her grandmother?s impeccably distressed cottage and affects Veronica Lake-esque bangs-in-the-eye sultriness. Rated PG-13 for mild cartoon action and some rude humor Time: 1:41 We gave the film: *?*? Extras: ?Zac and Taylor?s Amazing Chemistry? featurette

How would you change the Pantech Burst?

    How would you change

While ZTE and Huawei commence an assault on the high end of the market, companies like Pantech are nipping in behind to hoover up the budget space. When we reviewed the Pantech Burst, it was $50 on contract, but now can be picked up for $0.99. What do you get for less than a dollar? Stellar battery life (for an LTE phone), performance that easily matched a Samsung Skyrocket and LG Nitro HD more than compensate for its flaky capacitive buttons and weak camera. But, does the price justify turning a blind eye to its flaws? For a handset that costs less than a decent cup of coffee, what would you really change?

For Home Buyers That Want The Real Estate Commission For Themselves

I remember many years ago, long before I got into real estate, talking to a listing agent in another city about how I should be able to get the real estate commission on a purchase because I wasn't going to use a real estate agent. Wow! She looked at me like I was from another planet. What in the heck was I talking about? I HAD to use a real estate agent and there was no way an ordinary person could get a commission that was earmarked for the anointed. I was dumbfounded by her reaction, which just confirmed that the real estate industry was messed up.

That was probably 20 years ago and if you try what I tried today you probably wouldn't get quite the same reaction that I did but you might very well discover that saving the commission is not quite as easy as you think. We've actually gotten quite a few calls over the past few months from home buyers that are running into obstacles trying to do this.

Why is it so hard for a home buyer to receive the commission on a purchase? Well, in theory it shouldn't be and often home buyers can pull it off. But you can also run into a lot of hurdles along the way and it can get unbelievably complicated. For example:

The Listing Agent May Decide They Are Entitled To Both Sides Of The Commission

This is probably the most common problem that we see all the time. When a buyer represents him or her self the listing agent is absolutely going to do more work. The listing agent might have to show up for showings they would not otherwise have attended. They will have to answer more questions. They will have to do additional paperwork. They will have to do more hand holding. Given the choice between working with an unrepresented buyer and a represented buyer almost all agents, myself included, would choose to work with a represented buyer. This phenomenon is so real that when we sold my parents' home in Dallas earlier this year I offered the listing agent a higher commission for unrepresented buyers (but lower than the total commission with 2 agents involved).

Anyway, because of this dynamic many listing agents will refuse to give up any commission to an unrepresented buyer and this can get really sticky. For instance, they can make a very credible claim that they are the procuring cause of the buyer finding the home and therefore they are the only agent entitled to the buy side commission. Even if the buyer later brings in their own real estate agent the listing agent can refuse to pay them anything or the whole amount. In fact, in the Chicago suburbs it's not unusual to see a listing with a variation of this note: "If listing agent shows property, buyer's agent must pay 50% referral." I suspect that note is there to prevent a buyer's agent from swooping in at the last minute to collect a big fat commission.

The Listing Agent May Decide To Keep Both Sides Of The Commission Just Because They Can

This is actually a subtle variation of the previous issue often encountered. Technically the listing agent is entitled to the entire commission and they decide how to share it with a buyer's agent. If there is no buyer's agent they can keep both sides - even if they don't really do any additional work. Many listing agents will decide to exercise this right. They might even tell you that they are foregoing a portion of the commission but then still pocket the whole thing. You won't ever really know if they did - until perhaps closing.

The Listing Agent Might Insist That You Get Your Own Agent

This actually happened to some buyers who consequently became our clients. The listing agent was concerned about the buyers not having their own agent. Either it was an integrity issue for the listing agent or she wanted to avoid the difficulties of dealing with unrepresented buyers. In either case she told the buyers to get their own agent.

The Listing Agent May Believe That A Buyer Can't Receive The Commission

When I was taking one of the required Illinois real estate classes several years ago the instructor was actually the woman who wrote the book. She has been in the business since 1975 and has been teaching real estate classes since 1989. She has worked with the state and local real estate organizations on educational materials. Yet, when I told her that my business model involved a commission rebate to the buyer she insisted that I could not do this because it was illegal. I knew she was wrong so I just dropped it. But there are a lot of realtors out there that believe that buyers can not receive the commission.

How Exactly Do You Get The Commission And How Should It Be Documented?

There are actually 3 different ways that you can get the economic benefit of the commission. You could get a price reduction. You could get a credit on the closing statement. You could receive a check after closing. And there are a variety of documentation alternatives for these. The listing agent, the seller, the two attorneys, and most importantly your lender all have opinions on this. In fact, if not handled properly your lender can totally disallow the commission savings.

That reminds me. If you are buying a short sale or a bank owned property then the seller's lender has an opinion on this matter also and that opens up a whole other can of worms. In these cases the seller's lender can prevent you from getting the commission.

So Is There Any Way For A Home Buyer To Get The Commission?

Yes. And the solution is pretty simple actually. Just find a realtor that either rebates a healthy portion of the commission or works by the hour in exchange for a 100% rebate of the real estate commission. But, in light of the issues I discussed above, be sure to engage this realtor early on in the process - before you actually start seriously looking at properties. You can go to open houses by yourself but to keep the vultures at bay just tell the listing agent or their minions that you are already working with someone - but be prepared with a realtor's name in case they ask you.

With this approach, on a net basis, you won't get the full economic benefit of the commission but, depending upon the brokerage model you engage, you can get substantially all of it. In exchange for giving up some portion of the commission you will get the benefit of professional help. Like I always say you can change your own oil but is that really the best use of your time? The goal is not to "save" as much money as possible but rather to save as much money as possible without wasting your own time. If you effectively pay a realtor $75 - $100/ hour to do work that you would not do as well in twice the amount of time then that's a pretty good trade off.
